Ken,
The dirty secret here is that a high percentage of that "clear piracy" is splogs. When pressed, Attributor claims that as much as one-third of such uses are splogs, but that's just tracking use of the content from the big publishers who already use attributor, not content from bloggers who aren't very likely to sue.

A three-prong strategy for monetizing online content while reducing piracy is inevitable. In fact, we have the data that proves it will work, but only if the strategy (and solutions) are widely deployed by the major publishers. Our take on this is visualized by a one-page diagram at: http://info.icopyright.com/The-iCopyright-Platform.pdf
The problem with Attributor’s "Fair Syndication Consortium" is that it rewards infringers after-the-fact, rather than encouraging sites to do the right thing upfront. We have already proven that 99% of web users would license the content legally upfront for a fee — or for a share of the posting ad revenue, if they were given the ability by publishers to do so.
In fact, we currently process more than 25,000 ad-sharing licenses everyday. Why track down sites after they have done the wrong thing, when you can incent them to do the right thing to begin with? And by the way, the anti-piracy technology is only going to catch and convert a minority of the infringers on the back-end, while pro-active upfront ad-sharing technology will get 99% of the sites that want to post the content to participate.
